These Terms & Conditions (“Terms”) govern your purchases from GIGA MEGA SUPER via our website and our Etsy shop, production via Printful, and shipping to customers worldwide. If you place an order, you accept these Terms.

1. Identity & Contact

2. Scope & Applicability

  • These Terms apply to all B2C sales (business-to-consumer) made through the website and Etsy.
  • Production and fulfilment are handled via Printful, who prints/manufactures/ships on behalf of GIGA MEGA SUPER.
  • Orders may be shipped internationally; the rules of customs, duties, VAT (taxes) and import fees depend on destination and are the buyer’s responsibility (unless otherwise stated).

3. Orders & Contract Conclusion

  • An order is placed once you click “Place Order” (or equivalent) and make payment. At that moment, a contract is formed.
  • Before placing the order, you must be given the opportunity to review order details (product, quantity, price, shipping, total) and accept the Terms.
  • We reserve the right to refuse or cancel an order in case of out-of-stock items, error in price, or inability to fulfill.

4. Product Information & Safety

  • Product descriptions, images, size charts etc. are provided in good faith. Minor variations may occur.
  • For sales into the EU / EEA: we ensure compliance with the EU GPSR regulation. Safety warnings, materials, manufacturer or responsible party info will be included in product pages.
  • You agree that the fulfilment partner (Printful) may add information or labels required by regulation.

5. Pricing, Payment & VAT / Taxes

  • Prices are shown in [currency] and include Swiss VAT where required, or excluding where not. For international orders, VAT / customs / import taxes may apply and are usually paid by the buyer.
  • Payment is via secure third-party processors. GIGA MEGA SUPER does not store full payment card data.
  • In Switzerland, if total annual sales cross the thresholds required by Swiss law, we will be compliant with Swiss VAT registration etc.

6. Fulfilment & Shipping

  • Printful handles manufacturing, packaging, dispatch, and shipping.
  • Estimated shipping times are provided; delays may occur due to customs or external issues.
  • Once items leave the fulfilment centre, risk of loss or damage transfers to the buyer.

7. Returns, Refunds & Exchanges

  • For customers in jurisdictions with a statutory right of withdrawal (e.g. EU): you have the right to cancel your purchase within 14 calendar days of receiving the item. For other regions, returns are handled case-by-case.
  • Items must be returned unused, in their original condition, with tags and packaging. Personalized/custom items are non-returnable unless defective.
  • If item is defective or incorrect, please contact us within [e.g. 7] days with evidence (photos etc.). We cover return shipping in cases of our error. Refunds via same payment method within [e.g. 14] days after receipt and inspection.

8. Data Protection & Privacy

  • We process personal data in accordance with the Swiss FDPA (revised 2023) and, where applicable, GDPR for EU customers.
  • We act as Data Controller; Printful and Etsy act as data processors or separate controllers for certain processing.
  • We only collect the data necessary for order fulfillment, customer support, shipping, payments, and optional marketing (if consented).

9. Warranty & Liability

  • Under Swiss law, buyers have a 2-year warranty period for defects or non-conformity.
  • Our liability is limited to the purchase price of the Product. Indirect, punitive or consequential damages are excluded to the fullest extent allowed by law.

10. Intellectual Property

  • All designs, trademarks, content are © GIGA MEGA SUPER or used under license.
  • You may not reproduce or distribute them without permission.

11. Governing Law & Dispute Resolution

  • These Terms are governed by Swiss law.
  • For disputes, courts in the Canton de Vaud, Lausanne, shall have exclusive jurisdiction where legally permitted.
  • If consumer protection laws of another jurisdiction impose mandatory rules, those will prevail to the extent applicable.
